The Morning Machine Subscription Disclaimer

By signing up to join the Morning Machine Subscription, you agree to be bound by the Terms, and you warrant to us that you are at least 18 years of age, that you are resident in Singapore, that you are legally capable of entering into binding contracts, and that you will access the Morning Machine Subscription and its benefits for personal use only. If this is not true, or you do not agree to the Terms, you should not sign up to join the Morning Machine Subscription. Only one Morning Machine Subscription membership is available per person or household.

TERMS AND CONDITIONS

1.1 These terms and conditions govern your agreement with Akronym Pte Ltd. for a Morning Machine Subscription Plan. By choosing to purchase a Morning Machine Subscription Plan you accept these supplementary terms and conditions, in particular, the 12-month minimum subscription term (the “Minimum Term”). 

These terms and conditions may be modified from time to time by posting a new dated version on this website. You are invited to read these terms and conditions on a regular basis to be informed of these modifications.

How much is it

1.2 Your Morning Machine Subscription Plan has a fixed cost that will be charged to you through a Monthly Fee. The Monthly Fee is a fixed fee that varies depending on the Subscription Plan you select. 

1.3 The first Monthly Fee, will be payable at the time you sign up to the Morning Machine Subscription Plan. You shall pay the Monthly Fee based on your selected credit or debit card used to pay for this subscription. The subsequent Monthly Fees will be payable every month on the same day of the month (+/- 2 days) on which you originally took out your subscription.

Security checks

1.4 To ensure that your credit or debit card is not being used without your consent, we reserve the right to validate your name, address and other personal information supplied by you during the order process against appropriate third party databases. We also reserve the right to perform a credit check. By accepting these supplementary terms and conditions you consent to such checks being made. In performing these checks personal data provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information.

What’s included in the Morning Machine Subscription Plan?

1.5 In order to purchase a Morning Machine Subscription Plan, you must register an account on drinkmorning.com. When you purchase a Morning Machine Subscription Plan, you agree to pay the Monthly Fee each month for the duration of your subscription. 

1.6 Provided you pass our security and credit checks, the Morning Machine that goes with your Morning Machine Subscription Plan will be dispatched to you upon receipt of your first Monthly Fee in cleared funds. Your machine is guaranteed by the machine manufacturer pursuant to the warranty conditions listed in the original product documentation.

Cooling Off Period

1.7 You have the right to change your mind and cancel your Morning Machine Subscription Plan, without giving any reason, within 7 days after you purchase your subscription plan (the “Cooling Off Period”).

1.8 To exercise your right to cancel your Morning Machine Subscription Plan, you must inform us of your decision during the Cooling Off Period, by sending us a formal request here.

1.9 If you cancel the contract during the Cooling Off Period, we will repay you all payments received from you.

1.10 We will repay you using the same method of payment as you used to pay us. You will not incur any fees as a result of the repayment.

1.11 You must send back or hand over to us the Morning machine that you have received, or that was in transit at the time you notified us that you were exercising your right to cancel. We will make the repayment without undue delay, and in any event no later than 30 days after we have received the Morning machine back from you, or, if earlier, 30 days after you provide evidence that you have returned them. If you cancel before you have received the Morning machine, we will repay you within 30 days of the date you inform us that you are cancelling the Morning Machine Subscription Plan. We may withhold repayment until we have received the Morning machine back from you.

1.12 You must return both the Morning machine and coffee capsules received, unused and in good condition. If you do not, we may deduct from the refund the diminished value of the Morning machine and/or coffee capsules. 

How long does the subscription term last?

1.13 The Minimum Term for a Morning Machine Subscription Plan is 12 months and the Monthly Fee is payable in 12 monthly payments. The Minimum Term begins on the date on which your first Monthly Fee is received in cleared funds. After 12 months, your subscription will be automatically renewed until you decide to cancel it, as set out in section 1.16 below.

Cancelling your subscription before the 12-month minimum period.

1.14 Cancelling during the Minimum Term: if you wish to cancel your subscription before the end of the Minimum Term, you may do so by contacting our Customer Service Centre here. If you cancel before you have paid all 12 Monthly Fees, you will be required to pay a cancellation fee. The cancellation fee will be the appropriate cancellation fee for your selected Morning Machine Subscription Plan based on the length of your current subscription period (see below). You will not be entitled to a refund for any Monthly Fees already paid at the date of cancellation. You will own the Morning Machine and may keep existing coffee capsules sent to you after cancellation fees have been made.

1.15 If you fail to pay the Monthly Fee when due, Akronym Pte Ltd. (Morning) will freeze access to your Morning account and withhold sending coffee capsules until such payment is made. If payment is still outstanding 30 days after the Monthly Fee was due, Akronym Pte Ltd. (Morning) will issue a warning email to you as a reminder and if payment is still not made within the next 30 days, Akronym Pte Ltd. (Morning) may treat this as your giving notice of termination. You will have to pay the appropriate cancellation fee as set out at 1.14 above if the termination takes effect before the end of the Minimum Term.

What happens after the 12-month Minimum Term?

1.16 After the Minimum Term, your Morning Machine Subscription Plan will be automatically renewed at a reduced rate (see rates for “After 12 months” below), and will continue monthly until you cancel it. Two weeks before the Minimum Term ends, you will receive an email reminding you that the Minimum Term is coming to an end. To cancel, you will need to contact our Customer Relationship Centre here. There is no cancellation fee if you cancel after the Minimum Term.

1.17 After cancellation, the Morning Machine machine is yours to keep but you will no longer be entitled to the monthly coffee capsules previously delivered to you.

Limited Availability and other Conditions

1.18 This offer cannot be used in conjunction with other discounts, offers, privileges or promotions. You can only subscribe to the Morning Machine Subscription Plan once.

1.19 You are not allowed to transfer your Morning Machine Subscription Plan to another person.

Terms of Use

1.20 Akronym Pte Ltd. (Morning) reserves the right to change the subscription terms and conditions from time to time and at our sole discretion. Should that be the case, we will provide notification to subscribers affected by any such change and you agree that such changes shall be effective upon notification.

Governing Law

1.21 The present Subscription Terms & Conditions and all claims, disputes and controversies of any kind or nature arising in connection with the Subscription Terms & Conditions or your subscription, shall be governed by and construed in accordance with the laws of Singapore and shall submit to the exclusive jurisdiction of the courts of the Republic of Singapore.

Miscellaneous

1.22 Akronym Pte Ltd. (Morning) may, without prior notice, terminate the Morning Machine Subscription Plan (but this will not affect customers who have already signed up for it), and amend these terms and conditions. Akronym Pte Ltd. (Morning)’s decisions on all matters relating to this offer are final.
